CHUM FM & Sherway Gardens Shopping Centre * 104.5 CHUM FM and Sherway Gardens Shopping Centre (herein referred to as Sherway Gardens) are the sponsors of this contest presented on the air on 104.5 CHUM FM. There is one (1) grand prize to be won in this contest, as further described below. * The contest is open to all residents of the Province of Ontario with the exception of employees of CHUM Limited, Sherway Gardens, their respective advertising agents, subsidiaries and members of their immediate families, and persons with whom such employees are domiciled, winners of a major contest aired on 104.5 CHUM FM in the past one year (prize value of $1,000.00 dollars or more) and members of such immediate families, and persons with who such winners are domiciled. Winner must be 19 years of age or older to be eligible. * The one (1) grand prize in this contest consists of one (1) $10,000.00 dollar shopping spree exclusively at Sherway Gardens. The approximate retail value of the prize is $10,000.00 dollars (Canadian funds). * 104.5 CHUM FM and Sherway Gardens reserve the right to substitute the grand prize if deemed necessary. * The grand prize of $10,000.00 is in the form of 200 x $50.00 denomination gift certificates that are absolutely non-transferable. No cash or other prize substitution will be permitted. The full face value of each gift certificate must be directed towards an in store purchase, no cash redemption will be offered at point of sale. * 200 x $50.00 denomination gift certificates are valid until June 11, 2004 and ONLY valid at Sherway Gardens. ** How to win: There is only one (1) way to enter this contest to win the grand prize** * To qualify as a winner, a person must enter on line at www.chumfm.com between Wednesday, April 28th and Thursday, May 6th at 6:00 p.m. ALL ENTRIES FOR THE GRAND PRIZE MUST BE ENTERED BY 6:00 P.M. on Thursday, May 6th, 2004. mother, wife, daughter needs to win the $10,000.00 * On Friday, May 7th between (approx.) 6:30 a.m. – 7:30a.m. CHUM FM’s morning show hosts, Roger Ashby, Rick Hodge and Marilyn Denis, will call the conditional grand prize winner at the telephone number included in their entry. The conditional grand prize winning phone call will air prior to 9 a.m. The conditional winner must be available at the telephone number they provided. If an answering machine or voice mail box picks up the call, such conditional grand prize winner is disqualified. *Where, for whatever reason, there is not a clear telephone connection between 104.5 CHUM FM’s on air announcer and the conditional grand prize winner, such that one or each other cannot hear the other, such conditional grand prize winner is disqualified, and 104.5 CHUM FM is not responsible for any such failed connection. In conducting the contest, 104.5 CHUM FM’s on-air announcer has the full and absolute discretion to disqualify any conditional grand prize winner who fails to respond on the phone or whose response cannot be heard by such 104.5 CHUM FM representative, and 104.5 CHUM FM shall have no liability or responsibility to any caller so disqualified. * 104.5 CHUM FM will not be liable for any loss caused directly or indirectly by technical difficulties or errors in the administration of the contest or acts of GOD which may, among other things, result in a person other than the declared winner by 104.5 CHUM FM claiming to have won in the “104.5 CHUM FM/Sherway Gardens $10,000.00 Shopping Spree”- contest. Only a person declared by 104.5 CHUM FM to be a winner, will be entitled to a prize (subject to such winner’s eligibility for this contest and compliance with these contest rules). * The grand prize winner must pick up their prize (gift certificates) in person at Sherway Gardens on Saturday, May 8th at 1 p.m. * There will be one (1) grand prize winner randomly drawn on Friday, May 7th, 2004 (between approx. 6:30 a.m. – 7:30 a.m.) from all the eligible entries received via www.chumfm.com, via fax at 416-872-1045 or via mail at 1331 Yonge Street by 104.5 CHUM FM by 6 p.m. Thursday, May 6th, 2004. * The conditional winner of the grand prize will officially be declared a winner, after correctly answering a time-limited mathematical, skill testing question and signing a release form provided by 104.5 CHUM FM, failing which, the conditional winner forfeits all rights to the grand prize and is disqualified.
*The grand prize winner must execute a release and discharge of liability in connection with the prize in a form prepared by 104.5 CHUM FM, failing which, at 104.5 CHUM FM’s option, the prize will be forfeited. * Each contestant acknowledges that 104.5 CHUM FM and Sherway Gardens, has the right to reproduce, publicize and broadcast his/her name, address, likeness and voice the fact that he/she won the contest and all matters incidental thereto, without compensation. There will be a photo taken at Sherway Gardens on Saturday, May 8th, 2004 at 1p.m. * By participating in this contest, contestants and winner agree to be bound by these rules. In the event of any disagreement as to whether a person is eligible as a contestant, or a winner as to the qualifications of any winner, or as to the adequacy of the grand prize, the decision of 104.5 CHUM FM shall be final. * These contest rules are subject to change without notice, if necessary, in order to comply with any applicable law or policy of the CRTC or other entity having jurisdiction over 104.5 CHUM FM.
