CHUM FM’S PLAY @ WORK
OFFICIAL RULES AND REGULATIONS
1. TO ENTER the CHUM FM Play @ Work contest (the “Contest”), listeners must fill in an online registration form found at www.chumfm.com, click on the Contest page, complete and submit your entry by following the instructions found on the site during the Contest Period. You must be a CHUM Club Member to enter the Contest. You can join the CHUM Club, without a fee, at www.chumfm.com. In the event of a dispute, entries received on-line shall be deemed to be submitted by the "Authorized Account Holder" of the email address submitted at the time of entry. "Authorized Account Holder" is defined as the natural person who is assigned to an e-mail address by an internet access provider, on-line service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. All entries must include your first and last name, mailing address, email address, age, ten digit daytime and evening telephone number. Limit of one (1) entry per individual. If it is discovered that you attempted to enter more than once, all your entries will be void. Contest Entry Period starts on September 4, 2009 at 6:00 a.m. ET and closes on November 27,, 2009 at 2:25 p.m. ET (the “Contest Entry Period”). The Contest will run on-air, weekdays starting at 9:25 a.m. ET on Tuesday, September 8, 2009 until Friday, November 27 at 2:25 p.m. ET (with the exception of Thanksgiving Day) (the “On-Air Contest Period”). There is a maximum of one hundred and seventy-four (174) Secondary Prizes available to be won and one (1) Grand Prize available to be won. The number of Secondary Prizes to be awarded will depend on the number of successful contestants who call into the CHUM FM Play @ Work hotline number (416-870-2500) within 30 minutes upon hearing their name announced on-air, as described below. No purchase necessary. Void where prohibited.
From Monday through Friday of each week of the On-Air Contest Period, commencing on September 8 , 2009 and concluding on November 27, 2009 at or about 2:25 p.m. ET, and on Tuesday, September 8, 2009 at 8:45 a.m. ET for the September 8th Announcements, a representative of 104.5 CHUM FM will draw three listeners from all eligible entries received during the Entry Contest Period up to the time of the draw. The odds of being a selected listener on any applicable day depends on the number of eligible entries received during the Entry Contest Period up to 2:25 p.m. ET on that day. Commencing on September 8, 2009 and running until November 27, 2009 at each of 9:25 a.m., 11:25 a.m. and 2:25 p.m. ET, the 104.5 CHUM FM announcer will announce one of the listener’s name’s whose entry was drawn the previous weekday (the “Announcement”) (except that those entrants drawn on October 9, 2009 will be announced on October 13, 2009, and the entrants drawn at September 8, 2009 at 8:45 a.m ET who will be announced that same day), and tell that individual to call 104.5 CHUM FM at 416-870-2500 (CHUM FM’s Play @ Work exclusive hotline number) within 30 minutes of the Announcement Heads-Up Songs, as listed on at www.chumfm.com will be played immediately before the Announcement is made to alert listeners to the fact that the Announcement will be made shortly. In the event the entrant is outside of the local calling area, standard long distance rates as charged by the entrant’s long distance service provider will apply. If the listener calls through on the 104.5 CHUM FM at the Play @ Work exclusive hotline following the Announcement and before 30 minutes has expired, he/she will be notified that he/she is eligible to win (subject to the terms and conditions herein) a Secondary Prize and is eligible to be included in the Grand Prize draw, as described below. The eligible listener will be announced on air and may be required to chat on-air. If there is not a clear telephone connection between the CHUM FM on-air announcer and the potential Secondary Prize winner, such that one or each other cannot hear the other, such potential Secondary Prize winner will not be eligible to win the Secondary Prize or qualify for the Grand Prize draw, and the Contest Sponsor will not be liable in any way for such failed connection. In conducting the Contest on-air announcer has the full and absolute discretion to disqualify any potential Secondary Prize winner who fails to respond on the phone or whose response cannot be heard by such CHUM FM. Each eligible listener will then be required to provide a representative of 104.5 CHUM FM with their name, address and telephone number for the purpose of confirming their identity, and must correctly answer a mathematical skill-testing question in order to win the Secondary Prize and to qualify for the Grand Prize draw. If the listener announced does not get through to the station during the time-frame specified, he/she will not qualify for the Secondary Prize or Grand Prize draw, but will be placed back into the draw pool.
2. The contest sponsor is 104.5 CHUM FM, a division of CTV Limited (hereinafter referred to as the “Contest Sponsor”).
3. To enter and to be eligible to win, entrant must be a legal resident of Ontario and be eighteen (18) years of age or older. Employees and their parents, siblings and children, and persons domiciled with an employee of the Contest Sponsor, its agents, parent, affiliated or related companies, subsidiaries, divisions, prize sponsors, and promotional and advertising agencies and administrators, are ineligible to enter. A winner of a 104.5 CHUM FM Radio contest in the three (3) months preceding the start of this Contest (including persons designated by such winners to take ownership of prizes) are not eligible to enter.
4. Prize - There is a maximum of one hundred and seventy-four (174) Secondary Prizes available to be won, each consisting of One Hundred Dollars ($100.00). There is one (1) Grand Prize available to be won, consisting of Five Thousand Dollars ($5,000.00). Prizes are payable by cheque as described below. .
5. Prizes won must be accepted as awarded and will be awarded in the form of a cheque payable to the winner and must be picked up in person at 104.5 CHUM FM Radio, 250 Richmond Street West, Toronto, Ontario, at a time and date as specified by 104.5 CHUM FM Radio.
6. On November 30, 2009 between approximately 10:00 a.m. and 4:00 p.m. ET , a random draw for the Grand Prize will take place at 104.5 CHUM FM in Toronto, Ontario by the 104.5 CHUM FM Promotions & Marketing Director from among all eligible Secondary Prize winners. The first entry drawn will be eligible to win the Grand Prize. The odds of winning the Grand Prize will depend upon the total number of Secondary Prize winners, but will be no worse than 1 in 174. The Promotions & Marketing Director, acting reasonably, will attempt to contact potential winner by telephone immediately after the draw. In the event a potential Grand Prize winner cannot be contacted within 2 days, he or she may be disqualified and an alternate may, in the Contest Sponsor’s sole discretion, be selected. Proof of identification must be provided upon request. In order to be declared a winner, potential winner must first correctly answer, unaided, a time limited mathematical skill testing question administered by 104.5 CHUM FM. Before being awarded a Grand Prize, potential winner, will be required to sign and return within the time stipulated by the Contest Sponsor, a full release and indemnity form stating that he/she has read and understood these official rules and regulations (“Rules”), grants all consents required, authorizes the Contest Sponsor to broadcast, publish and disseminate his/her name, city of residence, photograph, likeness, sobriquet and voice, in connection with any promotion or publicity, and/or for general news, entertainment and information purposes at no additional compensation to the potential winner beyond the awarding of or participation in the Prize, accepts the Prize as offered and releases the Contest Sponsor from any and all liability of any kind arising out of the potential winner’s participation in this Contest and receipt and use of the Prize. In the event that the potential winner does not comply with all the provisions as contemplated in these Rules, Contest Sponsor shall have the right to disqualify potential winner and draw an alternate potential Grand Prize winner and the Contest Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard. The provisions and procedures referred to above relating to selection and notification of a potential winner shall be applied, with the necessary amendments, until a qualified Grand Prize winner has been duly selected.
7. By entering this Contest the entrants and participants automatically agree to accept and abide by these Rules. All decisions of the Contest Sponsor with respect to any aspect of this Contest, including without limitation the eligibility of entries, are final and binding on all entrants in all matters as they relate to this Contest.
8. All entries become property of Contest Sponsor who assumes no responsibility for garbled, in audible lost, late, delayed, destroyed or misdirected mail, voice messages, e-mail or any computer errors or malfunctions. No correspondence will be entered into except with entrants requesting Rules by mail or requesting names of prize winners (for which a self-addressed, postage paid envelope must be included). Contest Sponsor does not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, seeding or printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software or any combination thereof. Entry materials-data that have been tampered with or altered are void. If for any reason, in the opinion of the Contest Sponsor, in its sole discretion, the Contest is not capable of running as originally planned, or if the administration, security, fairness, integrity or the proper conduct of the Contest is corrupted or adversely affected, including by reason of tampering, unauthorized intervention, fraud, technical failures or any other causes beyond its control, Contest Sponsor reserves its right to cancel, terminate, modify, amend, extend or suspend the Contest, including canceling any method of entry and select a qualifier and/or winner from previously received eligible entries. Contest Sponsor reserve its right to modify the Rules without materially affecting the terms and conditions hereof. The Contest Sponsor reserves its right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of the Rules or otherwise in a disruptive manner. Any attempts to deliberately damage the Contest web site or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made the Contest Sponsor reserves its right to seek remedies and damages to the fullest extent of the law. Contest Sponsor shall not be held responsible for any errors or negligence that may arise or occur in connection with the Contest including any damage to an entrant’s computer equipment, system, software or any combination thereof, from downloading any material from the Contest web site, where applicable.
9. Contest is subject to all applicable federal, provincial and municipal laws and regulations. By entering this Contest, each entrant consents to the collection, use and distribution of his or her personal information (information that identifies an entrant as an individual, such as home telephone number, age and home address) by the Contest Sponsor for the purposes of implementing, administering and fulfilling this Contest. Contest Sponsor will not sell or transmit this information to third parties except for the purposes of administering this Contest. Any inquiry concerning the personal information held by the Contest Sponsor should be addressed to CTV Limited, 104.5 CHUM FM at 250 Richmond Street West, Toronto, Ontario M5V 1W4.
10. In the event of any discrepancy or inconsistency between the terms and conditions of the Contest Rules and disclosures or other statements contained in any Contest related materials, including but not limited to the Contest entry form, or point of sale, radio, television, print or online advertising, the terms and conditions of these Contest Rules shall prevail, govern and control.
11. All intellectual property, including but not limited to trade-marks, trade-names, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans and representations are owned by the Contest Sponsor and/or its affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
